Title 42 Gets Reprieve from SCOTUS

The full Supreme Court ruled today, 5 to 4, that the CDC’s Title 42 could remain in effect while the legal wrangling over it plays out.

The Biden administration has wanted from its outset to cancel this and all immigration policies of its predecessor–only it seems “not just yet.” Consider the fact that though Joe Biden announced his intention to abandon T42 early in his administration, he waited more than a full year–to April 1, 2022–to declare it finished. Even then, he pushed out the expected closure almost two more months, to May 23. By that time, litigation had set in and the policy has been a legal and political football ever since. A date of December 21 for its closing was eventually announced, but that day came and went with Justice Roberts issued an order temporarily extending it until the full court could join in. In the ensuring arguments, the White House continued to dawdle, its lawyers asking last week a delayed cancellation while they came up with some kind of plan to deal with the expected mad crush at the border.

In other words, though this administration clearly despises America, it’s too awash in incompetence to follow through just yet on its hatred.

The ruling today does not save Title 42. Eventually it will be abandoned, and the onrush of illegal migrants from all over the world, already breaking new records every month, will explode into numbers never before seen–while the mad emperor on Pennsylvania Avenue talks to movie stars and mutters empty reassurances that “all is well.”
