Judge Upholds ‘Remain in Mexico’

U.S. District Judge Matthew Kacsmaryk ruled that President Trump’s “remain in Mexico policy” must be reinstated. Its purpose was to prevent illegal aliens from reaching the United States to make fraudulent asylum claims. Their presence here gave them opportunities to stay indefinitely. Trump’s policy required assessment of asylum claims in Mexico.

In his ruling, which upheld lawsuits brought by Texas and Missouri. Judge Kacsmark stated that the U.S. can refuse “to admit asylum applicants at ports of entry . . . before they ever enter the United States.” He also affirmed that “The public interest favors the plaintiffs because the public has an ‘interest in stemming the flow of illegal immigration.’ ”

The Biden Administration eliminated “remain in Mexico” as one of its first actions. The administration plans to challenge Kacsmaryk’s ruling.
