Lawsuits are seeking to uphold the DACA amnesty that President Trump rescinded. They claim that the president did not go through the necessary procedures to repeal it. Kansas Secretary of State Kris Kobach affirms that these lawsuits are baseless. An authority on immigration law, Kobach notes that President Obama went through none of these procedures when he unilaterally proclaimed DACA in defiance of the Constitution.
“In other words,” said Kobach, “the plantiffs are claiming that even though President Obama did not jump over the necessary procedural hurdles to create DACA (which makes it null and void), President Trump still has to jump over those hurdles in order to end it.”
