Parliamentarian Rules Against Amnesty

Senate Parliamentarian Elizabeth MacDonough ruled that provisions to grant a large-scale amnesty to illegal aliens cannot be included, under reconciliation, in the Biden Administration’s budget bill. Reconciliation in budget legislation requires that provisions have a fiscal impact. MacDonough decided that amnesty did not meet this standard.

If she had allowed reconciliation, amnesty would have only needed 51 votes to pass, as opposed to the 60 votes usually needed to overcome a filibuster and pass legislation. This will be difficult for amnesty advocates to achieve, given the present balance of parties in the Senate.

White House press secretary Jen Psaki, speaking on behalf of the Biden Administration, said the parliamentarian’s decision was “deeply disappointing.”
