Judge Upholds Parole Program

U.S. District Judge Drew B. Tipton dismissed a lawsuit by Texas and twenty other states which sought to end the Biden Administration’s use of parole to admit 30,000 “asylum seekers” from the following countries: Cuba, Haiti, Nicaragua and Venezuela.

The plaintiffs argued that the administration was abusing the parole provision, which is supposed to grant U.S. residence to foreigners on a limited, case-by-case basis. They charged that the administration had created “a shadow immigration system.” They also maintained that the flow of migrants under the program was placing an economic burden on them.

Judge Tipton decided that the states did not make an effective case concerning their economic losses, so therefore they lacked standing for their lawsuit. He added, however, that he was not ruling on whether the administration’s use of parole is legal or illegal. Texas probably will appeal the ruling.
