Rotten Apple: Fined for Favoring Immigrants

The DOJ has successfully brought suit against Apple, Inc., for discriminating against US citizens in its hiring practices involved in the permanent labor certification (PERM) program.

According to Reuters: “Apple did not recruit U.S. citizens or permanent residents for jobs that were eligible for a federal program allowing employers to sponsor immigrant workers for green cards, in violation of a federal law that bars discrimination based on citizenship.”

The settlement, the largest ever for DOJ involving claims of discrimination based on citizenship, requires Apple to pay $6.75 million in civil penalties and $18.25 million to an unspecified number of affected workers, adding up to a grand total of $25 million.

According to the suit, Apple did not advertise on its website job openings that were eligible for PERM, as it routinely does for other positions. The PERM program is available to non-citizens but not restricted to them. Apple advertised the openings in a way that only non-citizens were likely to apply. It says it will do better.
