For Now, Texas Can Keep Its Barriers

The state of Texas has erected razor-wire barriers along the Mexican border to discourage the crossing of illegal aliens. Under orders from the Biden Administration, the Border Patrol has been removing the barriers. This removal must stop, at least temporarily, as the result of a lawsuit filed by Texas Attorney General Ken Paxton.

Judge Alia Moses of the U.S. District Court for the Western District of Texas ordered the administration on Monday to stop “disassembling, degrading, tampering” the razor wire. In his lawsuit, Paxton maintained that the federal government was claiming the right to destroy Texas property “to allow [illegal] aliens to enter [and] be processed.”

The judge’s temporary restraining order will remain in effect leading up to a hearing before the court on November 7, where both sides will continue to litigate. Paxton’s lawsuit is part of a broader effort by Texas to perform at least some of the border control that the administration is failing to perform.
