Appeals Court: DACA Illegal, but . . . .

In a decision rendered earlier this week, the 5th U.S. Circuit Court of Appeals declared illegal the Deferred Action for Childhood Arrivals (DACA) program, created by President Obama through executive mandate in 2012. Yet, like so much that is happening in American law and jurisprudence today, being illegal is no barrier to existing. The judges are allowing the program, now with 600,000 illegals under its protection, to continue, pending the decision of another court. The 5th Circuit judges merely ruled that no more individuals could be added in the meantime. Otherwise, they kicked the can down to a federal district judge in Texas to “review the program.”

Joe Biden expressed outrage at the decision and blamed “MAGA-Republicans,” his favorite pejorative for his most-despised political enemies. (“MAGA-Republicans” are, in Bidenworld, “semi-fascists” out to spoil the utopia of “equality and democracy” the Dems are trying to secure for us, whether we like it or not. They are doubleplusungood BAD!)

This is not the first time a judge has ruled DACA illegal. Last year, Judge Andrew Hanen of Texas found that Obama’s DHS had violated the Administrative Procedure Act (APA) in creating the program. Still, illegal or not, he also allowed the program continue, which it will no doubt do so until the Democrats seize sufficient control of Congress to establish it legally. By then, they may have the power to declare everyone legal, except perhaps those abhorrent MAGAs.
