SCOTUS: Title 42 Elimination on Hold . . . for Now

The CDC’s Title 42 policy, which permits for public health reasons the immediate expulsion of some illegal migrants crossing the border from Mexico, had been scheduled for expiration tomorrow, Dec. 21. In response to a lawsuit by 19 states, led by Arizona, on Monday Chief Justice John Roberts temporarily halted that expiration pending further action by the Court.

As reported here over the past year, the anticipated end of the policy–along with continuing encouragement from the Biden administration–has resulted in a huge increase in illegal border crossings by would-be “asylum seekers.” Both Administration officials and immigration restrictionists have predicted an even greater influx once Title 42 is eliminated. On Sunday, Dec. 18, for example, Gov. Greg Abbott of Texas told ABC News: “If the courts do not intervene and put a halt to the removal of Title 42, it’s going to be total chaos.” [Emphasis added.]

Justice Roberts gave the Administration until 5 p.m. today to respond to his order. He is expected to refer the matter to the full court.
