DACA Ruled Illegal, Again

Federal District Court Judge Andrew Hanen has ruled, for a second time, that the DACA program is illegal. DACA, which grants legal residence to illegal aliens who entered the U.S. as youngsters, came into being through a unilateral decree by former President Barack Obama. Prior to issuing the decree Obama admitted that he didn’t have the authority to issue such a decree because a law like DACA required the approval of Congress.

In his ruling Hanen stated, “While sympathetic to the predicament of DACA recipients and their families, this Court has expressed its concerns about the legality of the program for some time.

“The solution for these deficiencies lies with the legislature, not the executive or judicial branches. Congress, for any number of reasons, has decided not to pass DACA-like legislation.”

The court’s decision, however, did not call for the deportation of DACA recipients or ban new applicants. The Biden Administration said it was “deeply disappointed” by the ruling and that it would continue to fight legal challenges to DACA.
