Court Strikes Down Asylum Rule

A Federal District Court has overturned the Biden Administration’s policy of denying asylum to applicants who travel through other countries before applying for it in the United States. The Trump Administration initiated this policy on the premise that people who pass up opportunities for asylum in other countries are not really interested in asylum, but are only using it as an excuse to settle in the U.S.

The Biden Administration reinstituted this rule at the time that Title 42, a measure facilitating the expulsion of illegal aliens, was ending. The intention, it seemed, was giving the impression that there would still be a strong deterrent to bogus asylum claims. That it was a false impression was evident in the fact that Biden’s version of the rule was considerably watered down from the Trump version, with a number of exceptions and loopholes.

Some Washington observers speculate that the administration welcomed the court’s ruling as a way of getting rid of a policy it didn’t care for at all, and also as a legal president to prevent a future administration from reapplying the “other country” requirement for asylum applications.
