Obama DHS May Circumvent Amnesty Injunction

A leaked internal DHS memo from an off-the-record meeting reveals that the Obama administration is planning to sidestep key elements of the federal court injunction that suspended much of Obama’s amnesty edict of last November.  The Obama DHS strategy is to make “open market Employment Authorization Document (EAD) regulatory changes.”  EAD is the statutory term for work permits.  

The radical legal underpinning of the DHS memo is the implicit claim that the executive branch can issue EADs to anyone inside the U.S. borders, including illegal aliens and aliens here on visas not allowing employment.  Options being considered run from granting work permits to “all individuals living in the United States” to granting EADs to a more limited class of those with certain unexpired non-immigrant visas.
