Several groups are taking legal action against President Biden’s executive order which granted legal status, work permits, and a path to citizenship to 500,000 illegal aliens who are married to U.S. citizens. “This is a colossal amnesty, and a thunderous attack on American democracy in the form of an imperial edict,” said former Trump advisor Stephen Miller, who heads America First Legal.
Under the law passed by Congress, illegal aliens with citizen spouses can apply for legal residence if they return to their home countries and come back to make their applications. The Biden order ignores this requirement and allows them to stay and apply. This is unconstitutional because it is Congress is supposed to make laws, not the president.
Furthermore, the order abuses the power to grant parole stipulated by Congress in law. Biden has consistently abused this authority. Congress intended it to grant legal status to foreigners, under special circumstances, on a limited case-by-case basis. Biden’s large-scale and indiscriminate granting of parole violates the spirit and letter of the law.
