Court Considers Alien Law

The Supreme Court is considering the constitutionality of a law which makes it a crime to “encourage” or “induce” illegal aliens to remain in the United States. The Court is responding to a ruling by U.S. Court of Appeals for the 9th Circuit which held that the law is “overbroad and unconstitutional,” specifically on the grounds that it violates the First Amendment guarantee of free speech.

Supporters of the law maintain that the law refers to active aiding and abetting of illegal aliens’ residence, not to simple speech. The Justice Department supports the law and has argued its case before the Court. A ruling is expected in June.
