Birthright Citizenship Contested

President Trump issued an executive order to end birthright citizenship for the children of illegal aliens born in the United States. Almost immediately a federal district judge blocked the order. This probably will set the stage for a lengthy legal battle, which may end up in the Supreme Court.

Those supporting birthright citizenship claim that it is guaranteed by the 14th Amendment, which states that persons born in the United States under U.S. “jurisdiction” are citizens. Opponents say that jurisdiction doesn’t just mean residence but also loyalty to the United States. That would exclude illegal aliens. Much legal evidence supports this latter view.

In any case, a significant number of “citizen children” are born to illegal alien mothers each year. According to an estimate by the Center for Immigration Studies (CIS), the total for 2023 was 250,000, or seven percent of all U.S. births that year. As citizens, these children may qualify for the full range of public assistance benefits. This, of course, is also beneficial to their illegally residing parents.
