As we reported, the Supreme Court ruled that the Trump Administration, for now, can proceed with suspending “parole” 500,000 illegal aliens from Cuba, Haiti, Nicaragua, and Venezuela. This not the final resolution of the case, but it is a good start.
Predictably, illegal alien advocates–most of them Democrats–are in a dither about the Court’s ruling. George Fishman, the senior legal fellow for the Center for Immigration Studies, replied to them as follows: “Democrats are crying foul, saying Trump isn’t following the law. But it was President Biden who broke when he allowed these migrants here in the first place.”
Fishman noted that the the parole law passed in 1952 specifically stated that parole only allowed admission of foreigners in “emergency cases.” In 1996 Congress further stipulated that it was only to be granted on a “on a case-by-case basis.”
He further pointed to rulings by the 9th and 5th Circuit Courts. The latter maintained that the Biden Administration could not “parole aliens en masse; that was the whole point of the ‘case-by-case’ requirement that Congress added in [1996].” Fishman also observed the statement of the House of Representatives when it voted to impeach Biden’s DHS Secretary Alejandro Mayorkas for abusing the parole law.
That statement affirmed that Mayorkas deliberately exceeded his parole authority by “creat[ing], re-open[ing], or expand[ing] a series of categorical parole programs . . . which enabled hundreds of thousands of inadmissible aliens to enter the United States in violation of the laws enacted by Congress.”
When illegal alien advocates charge that the Trump Administration disregards the rule of law, they display a mind-boggling hypocrisy. The administration is simply trying to reverse their rule of lawlessness.
