Attorneys General Protest Proposal

More than a score of state attorneys general have called on the Biden Administration to rescind its proposal to give foreign farm workers, admitted under H-2A visas, collective bargaining rights which American farm workers do not have.

In a letter to the Labor Department, the attorneys general state that “The proposed rule violates the major questions doctrine because Congress did not clearly authorize the Department to grant foreign migrant farmworkers the right to unionize through the rulemaking process. This rule is not just a violation of the law. It is bad policy.”

The attorneys general represent the following states: Alabama, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Louisiana, Missouri, Mississippi, Montana, Nebraska, New Hampshire, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, and Virginia.
